ABSTRACT

The swift evolution of digital technologies has ushered in entirely new varieties of online crimes, these crimes include cyberstalking and deepfake-related crimes. Cyberstalking is a form of nonconsensual and repeated harassment online and through digital means. Deep fake crimes are ultimately based in part on the creation of synthetic media through Artificial Intelligence (AI) and deep learning. These crimes are often manifested in a pornographic, defamatory, or misinformation context. Even with existing cyber laws, the lack of any core legal provisions governing deepfakes presents unique problematic factors in the pursuit of justice in India. This research paper considers the developments, legal implications, and judicial response to cyberstalking and deepfakes and recommends amendments to strengthen India’s digital legal framework.
